Terms of Use

These terms are the agreement between you and Aspen Peak Partners LLC ("VeriVibe," "we," "us") for use of the VeriVibe iOS app. By using the app, you agree to them.

Subscriptions bought through the App Store are also covered by Apple's standard licence terms for in-app purchases.

1. Introduction and Acceptance of Terms

Welcome to VeriVibe ("VV," "the App," "our Service"). VV is a mobile application owned and operated by Aspen Peak Partners LLC ("APP," "we," "us," "our"), a Wyoming limited liability company. VV is a privacy-first artificial intelligence tool designed to help individuals evaluate dating profiles for authenticity and compatibility.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("user," "you," "your") and APP governing your access to and use of VV, including any content, features, functionality, and services offered through the App. By downloading, installing, accessing, or using VV, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not download, install, access, or use VV. We reserve the right to modify these Terms at any time. Material changes will be communicated to you through in-app notification before they take effect. Your continued use of VV after such notification constitutes acceptance of the modified Terms. If you do not agree to modified Terms, you must discontinue use of VV and delete the App from your device.

1.1 Eligibility

To use VV, you must be at least eighteen (18) years of age and legally able to enter into a binding agreement in your jurisdiction of residence. By using VV, you represent and warrant that you meet these eligibility requirements.

1.2 Nature of the Service

VV is a personal productivity and analysis tool. VV is not a dating app, matchmaking service, or social networking platform. VV does not connect users with other individuals, facilitate introductions, or host user profiles for the purpose of dating. VV provides AI-powered analysis of dating profile content that you, the user, choose to select and submit for evaluation. All analysis results are informational in nature and should not be construed as personal advice, professional guidance, or guarantees of any kind.

1.3 No Account Required

VV does not use accounts. There is no sign-up, sign-in, username, password, or email address. Your subscription and settings are associated with an anonymous identifier stored on your device. These Terms bind you as a user of the App on your device; references elsewhere in these Terms to "your data" mean the data held on your device and the anonymous identifier associated with it.

2. How VV Works: Screenshot Selection, Processing, and AI Analysis

VV combines three established technologies — user-selected screenshots, on-device optical character recognition (OCR), and artificial intelligence analysis — into a workflow designed to help you evaluate dating profiles. This section explains each component and how your data flows through the system.

2.1 Screenshot Selection

You take screenshots on your own device using the standard iOS screenshot function, exactly as you would for any other purpose. When you want a profile analyzed, you choose those screenshots from within VV using Apple's system photo picker.

2.2 On-Device Processing

Once you have selected screenshots, VV reads the text from them using Apple's Vision framework, which runs entirely on your device. This on-device text recognition makes no network calls. The screenshot images themselves are never transmitted to APP, to the AI provider, or to anyone else, under any circumstance. Only the text extracted from them leaves your device, as described in Section 2.3.

2.3 AI Analysis and Data Transmission

VV uses a third-party artificial intelligence provider, under contract to APP, to analyze the text extracted from your selected screenshots. Requests are routed through a secure interface operated by APP.

What is transmitted: The text extracted from your selected screenshots, together with your persona setting and the flags and preferences you have configured, is transmitted over an encrypted connection to the AI provider for processing.

What is NOT transmitted: Screenshot images are never transmitted. No information identifying you — name, email, location, or personal identifiers — is included in an analysis request. Requests are authenticated using Apple's App Attest, which verifies that a request came from a genuine copy of VV, not who is using it.

Provider handling: The AI provider does not use your text to train or improve its models, and does not retain your text after your result is returned.

Consent: Before your first scan, VV shows you a separate disclosure screen explaining that extracted text will be sent to a third-party AI provider, and asks for your explicit permission. Analysis does not occur unless you grant it. You may decline; declining disables scanning while leaving the rest of the App available to you. This is provided in compliance with Apple App Store Review Guideline 5.1.2(i).

VV may change AI providers in the future. VV maintains a provider abstraction layer to enable provider flexibility. Any change in AI provider will be disclosed, and the same data handling standards described in these Terms will apply to any successor provider.

2.4 Analysis Output

VV's AI analysis produces a compatibility and authenticity assessment, which may include a numerical score based on a multi-factor scoring model, identification of positive indicators ("green flags") and potential concerns ("red flags"), an assessment of profile completeness and communication quality, suggested conversation openers tailored to the analyzed profile and your selected persona, and a written explanation of the results. Analysis outputs are stored locally on your device in your scan history, subject to the retention limits in Section 5.

2.5 Analyzing Your Own Profile

VV also allows you to analyze a screenshot of your own dating profile. Self-analysis returns guidance rather than a score, is not saved to your scan history, and is subject to the same consent, transmission, and retention provisions as any other analysis.

3. User-Initiated Personal Tool — Not Automated Scraping

VV is a user-initiated personal productivity tool. This distinction is legally and functionally significant.

3.1 User Initiation

Every analysis performed by VV requires affirmative user action. You take the screenshots yourself, open VV, choose which screenshots to submit, and initiate the analysis. VV does not and cannot perform any of these actions automatically. There is no background scanning, no screen reading, no scheduled capture, no batch processing of profiles without individual user initiation, and no other automated data collection mechanism of any kind.

3.2 No Scraping, Crawling, or Automated Access

VV does not scrape, crawl, spider, or programmatically access any third-party application, website, database, or API. VV does not bypass authentication, access controls, rate limits, or any technical protection measure of any third-party service. VV never interacts with a dating platform at all — it operates only on image files you have already created and chosen to provide. What VV analyzes is the text in a screenshot you took, of a profile you were already looking at, on an app where you hold an account.

3.3 Functional Equivalence to Manual Review

Taking a screenshot is a standard capability built into every iOS device, used by hundreds of millions of people daily. VV adds text recognition and analysis to screenshots you have already taken. It does not extend, automate, or accelerate your access to any platform; it does not enable you to see anything you could not already see; and it cannot obtain content you have not personally captured. Any profile analyzed through VV is one you viewed yourself, screenshotted yourself, and selected yourself.

4. User Responsibilities and Acceptable Use

4.1 Your Responsibility for Third-Party Platform Compliance

You acknowledge and agree that the dating applications you use in conjunction with VV (such as Tinder, Bumble, Hinge, and other platforms) have their own terms of service, community guidelines, and privacy policies. You are solely responsible for understanding and complying with the terms of service of any third-party platform from which you capture content using VV. APP does not encourage, facilitate, or condone any violation of third-party terms of service.

You understand that many dating platforms prohibit or restrict the use of automated tools, bots, scraping software, and commercial data extraction. VV is not an automated tool, bot, or scraping software as defined by those platforms. VV is a personal analysis tool that operates on screenshots you take yourself. However, the interpretation and enforcement of third-party terms of service is solely within the discretion of those third-party platforms. APP is not responsible for any action taken by a third-party platform against your account as a result of your use of VV.

4.2 Permitted Uses

VV is licensed for personal, non-commercial use only. You may use VV to analyze dating profiles from platforms where you maintain an active account, for your own personal evaluation and decision-making purposes, on a device you own or control. You may share analysis results with trusted individuals for personal purposes (such as showing a friend your results for a second opinion).

You acknowledge that the dating profiles you analyze using VV contain content created by third-party individuals. That content may be protected by copyright, privacy rights, or other legal protections. By using VV, you represent and warrant that your capture and analysis of third-party dating profile content is for personal, non-commercial evaluation purposes only, that you will treat that content and the resulting analysis with reasonable care and respect for the privacy of the individuals concerned, and that you will not use VV to analyze profiles of individuals who are minors or who appear to be minors.

4.5 Responsibility for Third-Party Profile Content

The decision to select and submit profile content for analysis is yours alone. You represent and warrant that each submission is lawful, is limited to personal, non-commercial evaluation, and does not violate the rights of any person. APP does not select the content you analyze and does not obtain any consent on your behalf; in processing what you submit, APP relies on your warranties in this Section 4. Third-party claims arising from your submissions are addressed in Sections 9.5 and 10.

5. Data Handling, Retention, and Deletion

VV is designed with privacy as a foundational principle. This section describes how your data is handled within VV.

5.1 Data Minimization

VV collects and processes only the minimum data necessary to provide its core functionality. VV does not require any login. VV does not access your contacts, camera, microphone, or location, and does not receive access to your photo library — you pass individual screenshots to VV through Apple's system picker. VV does not serve advertisements and does not share data with advertising networks or data brokers.

5.2 On-Device Storage

VV does not store the screenshots you select. An image is held in memory only for as long as it takes to read the text from it, and is never written to VV's storage. Your own copy of each screenshot remains in your Photos library, where you created it; VV neither keeps nor deletes it.

What VV stores on your device is your scan history — analysis results, explanations, and related metadata — together with your flags, preferences, and persona setting. This data remains on your device under your control.

5.3 Automated Data Retention Limits

VV enforces automatic retention limits on scan history. History is limited to one hundred (100) entries or thirty (30) days, whichever comes first; older entries are removed automatically. You may delete individual entries or clear your entire history at any time in Settings.

5.4 Deleting Your Data

You may delete all of your data at any time using "Delete all data" in the App's settings. This removes your scan history, your flags and preferences, and your anonymous identifier. Uninstalling VV removes all App data from your device. Because VV holds no account and no server-side record of your scans, deletion on your device is complete deletion.

5.5 Data Not Retained by APP

APP does not receive or retain copies of your screenshots. APP does not maintain a database of analyzed dating profiles, and does not store analysis results on APP-operated servers — results are returned to your device and retained only there. APP's operational logs record technical facts such as whether a request succeeded and how long it took, and never the content of a request or a response.

The AI provider processes analysis requests and does not use submitted text to train its models. Submitted text is not retained by the provider after your result is returned.

6. Artificial Intelligence Disclosure and Limitations

6.1 Nature of AI Analysis

VV's AI analysis is provided for informational purposes only. Analysis results, including scores, flag identifications, and suggested conversation openers, are generated by machine learning models and represent probabilistic assessments, not definitive judgments. AI analysis is not a substitute for your own judgment. AI models can and do make errors, including misinterpreting tone, context, or cultural nuance.

You acknowledge and agree that VV does not guarantee the accuracy, completeness, or reliability of any AI analysis output. Scores and assessments are based solely on the text content of a dating profile and the preferences you have configured. They do not and cannot account for the full complexity of human compatibility. AI analysis does not verify the identity, truthfulness, safety, criminal history, or intentions of any individual whose profile is analyzed. VV's "authenticity" and "red flag" analysis identifies textual patterns that may be associated with inauthentic profiles. It does not constitute identity verification or background screening. VV is not a consumer reporting agency, and no score, flag, or other output constitutes a "consumer report" under the Fair Credit Reporting Act; VV must not be used for decisions about employment, housing, credit, insurance, or tenancy.

6.2 AI Provider and Data Handling

VV uses a third-party AI provider for analysis, under contract to APP. By using VV's analysis feature, and after granting the consent described in Section 2.3, you consent to the processing of extracted dating profile text by that provider. You acknowledge that the provider may change and that VV will disclose any such change. The provider's own terms and privacy policy govern its handling of data it receives, and APP requires its AI providers to process data in accordance with applicable privacy laws.

6.3 Prompt and Methodology Ownership

The system prompts, scoring methodology, analysis framework, persona definitions, flag criteria, and all other components of VV's AI analysis configuration are the exclusive intellectual property of APP. These components constitute trade secrets and proprietary information. The AI provider builds and maintains the technical infrastructure through which VV's prompts are executed, but does not own, and is not granted any rights in, VV's prompt content, scoring logic, or analysis methodology.

7. Intellectual Property

7.1 APP's Intellectual Property

VV, including but not limited to the App's design, user interface, source code, AI prompts, scoring methodology, analysis algorithms, brand identity, logos, and trademarks ("VeriVibe," the heart-checkmark logo), and all associated documentation, is the exclusive property of APP and is protected by United States and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in VV's intellectual property except for the limited license to use the App as described herein.

7.2 Your Content

You retain ownership of the content you create using VV, including your configured preferences, persona selection, and the analysis results generated from your scans. APP does not claim ownership of your analysis outputs. APP retains no copies of your analysis outputs; they exist only on your device.

7.3 Third-Party Content

Dating profile content analyzed through VV belongs to the individuals who created it and/or the platforms on which it was posted. VV's analysis of such content constitutes a transformative use for personal evaluation purposes. APP does not claim any ownership interest in third-party dating profile content.

8. Subscription, Payments, and Refunds

8.1 Freemium Model

VV operates on a freemium model. A limited number of analyses are available at no charge each calendar month. Access to additional analyses and premium features requires a paid subscription.

8.2 Subscription Terms

Paid subscriptions are processed through Apple's In-App Purchase system and are subject to Apple's terms and conditions for subscriptions. Subscriptions automatically renew unless canceled at least twenty-four (24) hours before the end of the current billing period. You may manage or cancel your subscription through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused portions of a subscription period. Price changes will be communicated in advance in compliance with Apple's requirements.

8.3 Refunds

Because VV subscriptions are processed through Apple's In-App Purchase system, refund requests must be directed to Apple in accordance with Apple's refund policies. APP does not have the ability to process refunds directly.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

VV IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. APP DOES NOT WARRANT THAT VV WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. APP DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI ANALYSIS OUTPUT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APP, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS (INCLUDING DEVELOPMENT PARTNERS), LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE VV, ANY AI ANALYSIS OUTPUT, ANY ACTION TAKEN OR NOT TAKEN IN RELIANCE ON AI ANALYSIS, OR ANY INTERACTION WITH ANY INDIVIDUAL WHOSE PROFILE YOU ANALYZED USING VV.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APP'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF VV SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO APP FOR YOUR VV SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

9.3 AI Analysis Is Not Advice

VV's AI analysis is informational and is not intended to constitute personal advice, relationship counseling, background screening, identity verification, safety assessment, or any form of professional guidance. You are solely responsible for your own decisions regarding dating, relationships, and personal safety. APP strongly encourages you to exercise independent judgment, take appropriate personal safety precautions when meeting anyone from a dating platform, and never rely solely on VV's analysis when making decisions about personal safety.

9.4 Third-Party Platforms

APP has no affiliation with, endorsement by, or relationship with any third-party dating platform, including but not limited to Tinder (Match Group), Bumble (Bumble Inc.), or Hinge (Match Group). VV is an independent third-party tool. APP is not responsible for the content, accuracy, policies, or practices of any third-party dating platform. APP does not control and is not responsible for the availability, functionality, or terms of service of any third-party platform.

9.5 Content Concerning Other Individuals

VV analyzes content that you select and submit, which may concern individuals other than yourself. APP makes no representation that any individual whose profile you analyze has consented to that analysis, and, to the maximum extent permitted by applicable law, disclaims all liability arising from your capture, submission, analysis, or use of content concerning any other individual. Responsibility for the lawful capture and use of such content rests with you, as described in Sections 4 and 10.

10. Indemnification

You agree to indemnify, defend, and hold harmless APP, its members, officers, employees, agents, contractors, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of VV, your violation of these Terms, your violation of any applicable law or regulation, your violation of any third-party platform's terms of service, your use or misuse of any AI analysis output, or any claim by a third party related to content you captured, shared, or otherwise used through VV.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

11.2 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact APP at legal@verivibe.ai and attempt to resolve the dispute informally for a period of at least thirty (30) days.

11.3 Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of VV shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Wyoming or, at your election, via telephone, video conference, or written submission. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

11.4 Class Action Waiver

YOU AND APP AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration against APP.

11.5 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights. Claims within the jurisdiction of small claims court may be brought in small claims court in lieu of arbitration.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy and any supplemental terms or policies referenced herein, constitute the entire agreement between you and APP regarding your use of VV and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

12.3 Waiver

The failure of APP to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver of any provision shall be effective only if made in writing and signed by APP.

12.4 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without APP's prior written consent. APP may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, provided that the assignee agrees to be bound by these Terms.

12.5 Notices

Because VV does not use accounts and collects no contact information, notices to you will be provided through in-app notification. Notices to APP should be sent to: Aspen Peak Partners LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, United States, or by email to legal@verivibe.ai.

12.6 Force Majeure

APP shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, internet or telecommunications failures, or third-party service provider outages (including AI provider outages).

12.7 Survival

Sections 4.3 (Prohibited Uses), 6 (AI Disclosure and Limitations), 7 (Intellectual Property), 9 (Disclaimers and Limitation of Liability), 10 (Indemnification), 11 (Dispute Resolution), and 12 (General Provisions) shall survive any termination or expiration of these Terms.
